Weka.io respects your privacy. This policy explains the accepted privacy practices for the Services available at www.Weka.io (the “Website“) and the other services provided by Weka.io (collectively the “Services“).

The Services are not intended for use by persons under the age of 18. If you are not 18 years old or older, then you may not register with the Services and must not provide the Services with any of your personal details.

This Policy is incorporated into the Services’ Terms of Use (the “TERMS OF USE) and constitutes an integral part of them.

Personal Information

When you register to the Services, you will be asked to provide personal details. The fields for compulsory completion will be specifically designated. You may later add additional details by entering your settings page.

When you use the Services, Weka.io may collect further information, such as session durations, page impressions, advertisements viewed or clicked on, Internet protocol (IP) addresses, the domain name that served you to access the Services, the geographic location of the computer system that you are using to log-in, and content types and origins. Weka.io may also track further information relating to you, when you activate and access the Services, such as the frequency and the extent of your use of the Services.

Weka.io may automatically collect information through the use of log files and other means. If you register with the Services, then the information gathered may be partially personally identifiable. If you are not a registered user, then we will not knowingly make use of any information, which personally identifies you, except as specifically indicated in this policy, or on the Website.

Further information may be collected when we exchange communications with you, for example, when you submit an inquiry, or a request, or if our designated copyright agent contacts you.

What does Weka.io do with your personally identifiable information?

Where Weka.io is the Controller of data, it will process data only on a lawful basis, generally based on the consent of the data subject; or based on the fulfillment of contract; or based on a legitimate interest of providing information and services and support with respect to the Services.

Weka.io may use personally identifiable information for the following purposes:

to provide and operate the Services;
to improve and customize your experience with the Services;
to provide you with support and handle questions and requests;
to send you updates and notices, to provide you with information relating to the Services, and to provide you with further marketing and advertising material. At any time you may opt out of the mailing lists, by changing your preferences in your personal account. Third party commercial information will not be sent to you unless you agreed to receive it during registration to the Services or afterwards. In any case, Weka.io will not share your personal identifiable details with any advertisers, without your explicit consent;
to facilitate communications with you, and between you and others
to enforce the Website’s Terms of Use and the Software’s End User License Agreement;
to contact you as and when Weka.io believes it to be necessary;
to comply with any applicable law and assist law enforcement agencies as required;
In any case where Weka.io believes that the use of the information is necessary to prevent imminent physical harm or damage to property;
to collect fees and debts, and to prevent fraud, misappropriation, infringements, identity thefts and any other misuse of the Services;
to take any action in any case of dispute, or legal proceeding of any kind between you and Weka.io, or between you and other users or third parties with respect to, or in relation with the Services;
to display your email address on search results of queries made by other users of the Website;

How does Weka.io use aggregated information?

Weka.io may use anonymous, statistical or aggregated information related to the use of the Services, including any aggregated information related to your personal account, and share, publish, post, disseminate, transmit or otherwise communicate or make available such information, to suppliers, business partners, sponsors, affiliates and any other third party, at Weka.io’s sole discretion, provided however, that the information will not identify you personally and that Weka.io will not knowingly, or intentionally use the information to reveal your identity without your consent, under the terms of this policy.

Weka.io may also use anonymous, statistical or aggregated information to properly operate the Services, to improve the quality and functionality of the Services, to enhance your experience, to create new services, including customized services, to change or cancel existing content or services and for other internal and statistical purposes.

How does Weka.io share information with others?

Weka.io will not share personal data with any third party except in limited circumstances, in which those third parties support our Services to our customers, employees, and website users. This may include: CRM, billing, payroll, communication, lead management, marketing services and website services, data backup services and other similar services ordinarily used by organizations such as Weka.io.

We may share personal information with third parties in connection with legal or regulatory proceedings or investigation, enforcement or protection of our rights, a sale of our business or other corporate due diligence, in compliance with legal process, or in any other case where we believe in good faith that disclosure is required by law or by generally accepted best business practice. We will make reasonable efforts to obtain from such third parties assurance that they will treat all personal information in accordance with GDPR and all applicable law, and that such third parties performing services on our behalf are required to, and will in fact, use that information only for the purposes agreed with us or required by law.

When we share data with third parties, we may in some circumstances remain liable for the treatment of such data with respect to GDPR, except where we are not responsible for the events giving rise to the damage.

We may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Weka.io may also share personally identifiable information with companies or organizations connected, or affiliated with Weka.io, such as subsidiaries, sister-companies and parent companies.

In case of onward transfer to third parties of data of EU and Swiss individuals received pursuant to the EU-US Privacy Shield and Swiss-US Privacy Shield, Weka.io is potentially liable.

How can you access your personal information?

Weka.io acknowledges that EU and Swiss individuals have the right to access the personal information that we maintain about them. An EU or Swiss individual who seeks access, or who seeks to correct, amend, or delete inaccurate data, should direct their query to privacy@Weka.io. If requested to remove data, we will respond within a reasonable timeframe.

We will also provide an EU or Swiss individual with opt-out or opt-in choice before we share their data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized.

Data Subject Access Rights

You have rights of access, portability, rectification and erasure, all as described in GDPR, and where we are the data Controller, you may contact us (privacy@Weka.io) to help exercise those rights. When technically feasible, at your request we will provide your personal data to you or transmit it directly to another controller. As a data subject you may have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process your personal data. You may lodge a complaint against Weka.io by writing to the Data Protection Authority, and you may contact our Data Protection Officer with regard to your data subject rights – details below.

We will not be able to provide access to data where such access would lead to divulging proprietary information, or may impinge the rights of employees or others.

Data retention

Weka.io will erase personal data once it is no longer serving its purposes, and is no longer needed for legal, compliance, audit and other such needs. Data processed on behalf of our customers will be erased on their instructions, and generally by them on our platform. Weka.io reserves the right at all times to review, retain and disclose any information as it deems necessary to satisfy any applicable law, regulation, legal process or governmental request, as well as Weka.io’s internal needs. However, by doing so Weka.io does not either expressly or impliedly endorse, affirm or in any manner assume any responsibility for such information.

Information Security

Weka.io implements information security systems and procedures to secure the information stored on its servers. Such systems and procedures reduce the risk of security breaches, but they do not provide absolute security. Therefore, Weka.io cannot guarantee that the Services will be immune to unauthorized access to the information stored therein and to other information security risks.

Cookies

Weka.io may use cookies when operating the Services. Cookies are packets of information sent by Weka.io’s servers to your web browser and then sent back by the browser. Weka.io may use cookies for various purposes, for example, to save you the need to re-enter your password each time you log-in to the Services, to facilitate the use of the Services, to collect information for statistical and analytical purposes, to verify information, to customize the Services to your personal preferences and for information security purposes.

Advertising

Changes to this Privacy Policy

Weka.io may change and update the terms of this policy from time to time. Therefore, it is recommended that you read it periodically. All substantial changes made to this policy will be notified on the Website, or in your personal account, at Weka.io’s discretion, and take effect 7 days following their initial posting, or otherwise is required under the applicable law. Other changes will take effect immediately upon notice.

Transfer of data outside your territory

The Services, by their nature as online services, may store and process information and (including through cloud services) in Europe, Israel, the United States and in other various locations throughout the globe.

Weka.io operates from Israel, a country recognized by the EU Commission as having adequate protection under EU data protection laws.

Weka.io complies with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland transferred to the United States pursuant to Privacy Shield. Weka.io has certified that it adheres to the Privacy Shield Principles with respect to such data. If there is any conflict between the policies in this privacy policy and data subject rights under the Privacy Shield Principles, the Privacy Shield Principles shall govern. Weka.io is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC.)

In compliance with the Privacy Shield Principles, Weka.io commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to Privacy Shield. European Union and Swiss individuals with Privacy Shield inquiries or complaints should first contact Weka.io at: privacy@Weka.io.

Weka.io has further committed to refer unresolved privacy complaints under the Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD, operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not

satisfactorily addressed, please visit www.bbb.org/EU-privacy-shield/for-eu-consumers for more information and to file a complaint. This service is provided free of charge to you.

If your Privacy Shield complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms.
